Free Sounds License Agreement

1. Grant of License

Online Forever Music grants you a non-exclusive, royalty-free, worldwide license to download, use, and incorporate the sounds made available through the Free Sounds catalog ("Sounds") into your creative works, including music productions, videos, podcasts, films, games, and other multimedia projects, subject to the terms and conditions set forth herein.

2. Permitted Uses

• Use Sounds in an unlimited number of original creative works.
• Use Sounds in commercial and non-commercial projects.
• Modify, chop, layer, pitch-shift, or otherwise transform a Sound as part of a larger composition.
• Distribute your final creative work (e.g., a song, video, podcast episode) that incorporates a Sound.
• Sync Sounds to visual media including film, television, and online video.

3. Prohibited Uses

• Redistribute, resell, sublicense, or otherwise make the original Sound file available to third parties as a standalone audio file, sample pack, loop library, or sound effect collection.
• Claim ownership of a Sound or register it with any content identification system (e.g., YouTube Content ID) in a way that would restrict others' ability to use the Sound.
• Use a Sound in a project that promotes hate speech, violence, or illegal activity.
• Remove or obscure any metadata, attribution, or licensing information embedded in a Sound file.

4. Prohibited Activities

• No automated access, scraping, data mining, or bulk downloading of Sounds using bots, scrapers, crawlers, or other automated tools.
• No use of Sounds or associated content for training machine learning models, AI algorithms, or any artificial intelligence system without explicit prior written authorization from Online Forever Music.
• No circumventing, disabling, or otherwise bypassing download limits, access controls, or other security measures implemented on the platform.

5. Ownership

All Sounds remain the intellectual property of their respective uploaders and/or Online Forever Music. This license grants you rights to use Sounds as described above; it does not transfer ownership of any Sound to you. Online Forever Music and the original creators retain all copyright and ownership rights not expressly granted herein.

6. Representations and Warranties

• By downloading: you acknowledge that this license is non-exclusive and that other producers and creators may have downloaded and may use the same Sounds in their own works.
• By downloading: you agree not to register Content ID claims, copyright claims, or similar rights-management claims against other users who independently use the same Free Sounds in their own works.
• If you incorporate a Free Sound into a derivative work and register that work with content identification systems (including YouTube Content ID, DistroKid, TuneCore, or similar services), you will not submit takedown requests, dispute claims, or otherwise assert rights against other users who use the same underlying source Sound.
• By uploading (when community uploads are enabled): you represent and warrant that the content is 100% your own original work, contains no third-party copyrighted material (samples, loops, recordings, or compositions) for which you do not hold all necessary rights, and that you have full authority to grant the license described herein to all downloaders.

7. No Warranty

The Sounds are provided "as is" without warranty of any kind, express or implied. Online Forever Music makes no representations or warranties regarding the fitness of any Sound for a particular purpose, non-infringement of third-party rights, or the accuracy of any associated metadata. Your use of the Sounds is entirely at your own risk.

8. Termination

This license is effective until terminated. Your rights under this license will terminate automatically, without notice, if you fail to comply with any of its terms. Upon termination, you must cease all use of the applicable Sound(s) and destroy any copies in your possession. Provisions that by their nature should survive termination (including Sections 5, 7, 9, and 10) shall survive.

9. DMCA Notice

If you believe that a Sound infringes your copyright, please submit a DMCA takedown notice through our Report page. Online Forever Music will investigate all good-faith notices and take appropriate action, including removing the infringing Sound if required. Counter-notices may be submitted in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512.

10. Governing Law

This license shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any dispute arising under or in connection with this license shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York.
